Terms of sale
1. General

These Terms of Sale apply to all services and products provided by Empelvic Physiotherapy (“we”, “us”, “our”).
By booking an appointment, purchasing a service, or engaging with our services, you agree to these Terms.

2. Services
​
We provide physiotherapy services, including but not limited to:

Initial consultations

Follow-up consultations
-
Pelvic floor assessments (including internal examinations where appropriate)

Pregnancy and postnatal services
-
Telehealth consultations
-
Exercise programs and educational resources
​
All services are delivered in accordance with professional clinical standards.

3. Fees and Payment
​

All fees are payable at the time of appointment unless otherwise agreed
-
Fees may be updated from time to time and will be communicated prior to your appointment

Payments may be processed via EFTPOS, online payment systems (Tyro), or other available methods
​
You are responsible for any fees not covered by third parties (e.g. insurers or workers compensation).
​
4. Cancellations and Missed Appointments
​
We require at least 24 hours’ notice for cancellations or rescheduling. Late cancellations or missed appointments will incur a cancellation fee of 50% of the appointment fee.
​
We understand that situations arise and may waive fees at our discretion.
​
5. Refunds and Australian Consumer Law
​
We comply with the Australian Consumer Law (ACL).

You are entitled to a refund or remedy where services are not provided with due care and skill

Change of mind does not entitle you to a refund

Prepaid services or packages are non-refundable unless required under law

6. Packages and Prepaid Services
​
Where you purchase a package or prepaid service:

Sessions must be used within a reasonable timeframe (e.g. within pregnancy/postnatal period or as advised)

Packages are non-transferable unless otherwise agreed
-
Missed appointments within a package may be forfeited if cancellation policy is not met
​
7. Telehealth Services
​
For Telehealth appointments:

You are responsible for ensuring a suitable environment and internet connection

We are not responsible for disruptions caused by technical issues outside our control
-
Telehealth may not be suitable for all conditions and clinical judgement will be applied
​
8. Client Responsibility
​
You agree to:

Provide accurate and complete information about your health

Follow clinical advice and prescribed exercises appropriately
-
Inform us of any changes to your condition
​
Outcomes may vary between individuals, and no guarantee of specific results is provided.
​
9. Consent to Treatment
​
By attending an appointment, you consent to assessment and treatment, including:

Physical assessment
-
Exercise prescription
-
Pelvic floor assessment (including, where clinically indicated, internal examination with confirmed verbal consent)
You have the right to decline or withdraw consent at any time.

10. Limitation of Liability
​
To the maximum extent permitted by law, we are not liable for any injury, loss or damage arising from:

Failure to follow clinical advice

Participation in prescribed exercises

Use of educational materials outside of guidance

Where liability cannot be excluded, it is limited as permitted under Australian law.
​
11. Third-Party Funding (e.g. Workers Compensation)
​
Where services are funded by a third party:

You remain responsible for payment if the third party does not pay or declines the claim

We may invoice the third party directly where arrangements are in place
​
12. Privacy
​
Your personal and health information is handled in accordance with our Privacy Policy.
​
13. Changes to Terms
​
We may update these Terms of Sale from time to time. The latest version will be available on our website.
​
14. Governing Law
​
These Terms are governed by the laws of Western Australia, Australia.
